Mehul Choksi’s lawyer moves court in Dominica, says he has ‘torture marks’, was abducted from Antigua


One day after his arrest in Dominica for allegedly illegally entering the island countryThe legal team of the fugitive businessman Mehul Choksi has filed a habeas corpus petition in Dominica.

His lawyer Vijay Aggarwal has confirmed this to India Today TV.

Habeas Corpus is a script according to which an arrested person must be brought before a judge or in court.

In the petition, Mehul Choksi’s lawyer alleged that his body had “traces of torture.” It has also been alleged that Mehul Choksi was “forcibly apprehended” against his will by Antigua and Barbuda.

According to ANI news agency, Mehul Choksi’s legal team has also highlighted that he has been deprived of access and constitutional rights to legal aid.

“Our lawyer in Dominica only had access to him (Mehul Choksi) for two minutes. He (Choksi) shared his terrible experience. He said that various people picked him up from Jolly Harbor in Antigua and took him to Dominica by force.” , Vijay Aggarwal of ANI was quoted as saying.

Vijay Aggarwal said that once Mehul Choksi obtained citizenship of Antigua and Barbuda, he would no longer be an Indian citizen under Indian law.

“Under the Immigration and Passport Act, he can only be deported to Antigua,” he said.

Mehul Choksi is wanted in the Punjab National Bank fraud case in the amount of 13,500 rupees. He was arrested on Wednesday in Dominica for allegedly “illegally” entering the country from Antigua and Barbuda, where he has lived since January 2018.

Why is Mehul Choksi wanted?

Mehul Choksi and his nephew Nirav Modi are wanted for allegedly withdrawing Rs 13,500 of public funds from the state-run Punjab National Bank (PNB) with letters of commitment.

While Nirav Modi is in a London prison after being repeatedly denied bail Mehul Choksi is denying extradition to India and in 2017 took citizenship of Antigua and Barbuda through the Citizenship by Investment program before fling India in the first week of January 2018.

The fraud later came to light. Both stand in front of a CBI probe.

Mehul Choksi faces two falls, Antigua and Barbuda. One deals with his extradition to India and the other with the revocation of his citizenship.
