It added that after each round, the returnees (RO) at Nandigram made sure that the votes requested from each candidate were written on the scoreboard that could be easily seen by the counters.

“No doubt was expressed about the round count result. This enabled the RO to continue counting votes uninterrupted,” said the electoral body.

The statement said that after the Nandigram census ended, the electoral officer of a particular candidate (Mamata Banerjee) requested a recount of votes. This was rejected by the RO “on the basis of the material facts available to it”.

The commission said the only remedy in such a case would be to file a petition with the Calcutta Supreme Court and vote.

Regarding the recount, the electoral body said the returning officer of the relevant seat was the “final legal authority”.

“The returning officer of a constituency of the congregation exercises the legal functions under the Representation of People Act of 1951. Regardless of whether it is a nomination, a vote or a census, the RO acts in strict accordance with the applicable laws Electoral laws, instructions and guidelines of the EC. “

The Chief Minister of West Bengal and TMC Commander in Chief Mamata Banerjee denied the elections for the West Bengal Assembly from Nandigram. Her main competitor was the BJP leader and her former protégé Suvendu Adhikari.

On May 2, when the votes were counted, the TMC swept the state and won 214 seats in the 294-member congregation. However, Mamata Banerjee lost her own seat in Nandigram with 1,956 votes.

After the results were published, the TMC requested a recount in Nandigram. The application was rejected by the electoral commission.

On Monday, Mamata Banerjee alleged the returning Nandigram official did not order the vote recount even after she requested it because he “feared for his life”.

Meanwhile, the electoral commission ordered the state government to respond to media reports of the tension in Nandigram and undue pressure on the returning officer (RO) to provide him with adequate security.

The commission has also directed the Chief Electoral Officer of West Bengal to ensure the safekeeping of all election records, including interrogated EVM / VVPAT, video recordings, legal documents, census records, etc., strictly in accordance with the commission’s established guidelines / instructions.

The state government has now given the returning officer security.
