The Drugs Controller General of India (DCGI) has found the Gautam Gambhir Foundation guilty of illicitly storing, procuring and distributing Fabiflu drugs to COVID-19 patients, the Delhi Supreme Court was informed on Thursday.

The DCGI submitted a new report to the court following a previous reprimand for giving Gambhir’s Foundation a clean slip. The drug inspector asserted that immediate action would be taken against the organization, drug dealers and other such cases that were brought to his knowledge.

AAP MLA Praveen Kumar has also been found guilty of similar offenses under the Medicines and Cosmetics Act, the court was informed.

Earlier in the case related to drug hoarding, The Delhi Supreme Court had dismissed earlier DCGI reports and gave Gambhir and Kumar clean slips of paper. The department bank of Judges Vipin Sanghi and Jasmeet Singh ordered a new report and investigation on Monday.

However, the court was satisfied with the Drugs Controller report filed for another AAP MLA Preeti Tomar. The same department bank had previously ordered the inspector to investigate them on similar charges.

On Thursday, the drug inspector was requested by the court to provide status reports on further progress in these cases within six weeks. The matter was brought up for trial on July 29th.

The trial follows a PIL that challenged how politicians were able to source and distribute large quantities of certain drugs – needed to treat Covid-19 – as patients and medical supply stores faced acute shortages.
