Twitter has lost legal protection in India for failing to appoint legal representatives under the new IT rules.
Sources said Wednesday that the microblogging platform in India lost legal compensation after failing to comply with the new social media rules that required it to appoint key officials in India.
Twitter has failed to abide by the rules despite letters from the ministry, sources said, adding that no order will be issued to remove the social media platform’s intermediary status.
However, Twitter said Tuesday it had followed the Indian government’s new IT rules and appointed an interim chief compliance officer.
“We keep MeitY informed of the progress at every step of the process. A provisional Chief Compliance Officer has been hired and details will be communicated directly to the Department shortly. Twitter continues to make every effort to comply with the new guidelines, ”a Twitter spokesperson told India Today.
What is legal protection?
Broker status gives social media platforms immunity from liability for any third party data they host.
According to the new IT rules, non-compliance with the social media platform can lead to the social media platform losing its intermediary status, and the platforms could also be prosecuted in the event of a complaint.
What is the problem?
The new IT rules, first announced by the government in February, required tech companies in India, including WhatsApp, Facebook, Google and others, to appoint a chief compliance officer, node officer and complaints officer in the country.
While WhatsApp and Facebook appointed their respective complaints officers for India earlier this month, Twitter India reached out to the government to ask looking for more time to comply with the new IT rules which first came into force on May 25th.
In one Statement on India Today, prior to compliance, Twitter expressed concern about the requirement to hold one person (the compliance officer) criminally liable for content on the platform, the requirements for proactive monitoring, and the blanket authority to collect information about our customers.
This is a dangerous attack that is incompatible with open, democratic principles. “In order to keep our service available, we will endeavor to comply with the applicable laws in India. But, like around the world, we will continue to be strictly guided by the principles of transparency, a commitment to empower every voice in the service. and the protection of freedom of expression and privacy under the rule of law, “said a Twitter spokesman.
In response, the center had labeled Twitter’s statement as “unfortunate,” totally unfounded, false, and an attempt to defame India in order to hide its own follies. The center said Twitter is refusing to “strictly follow the rules in the ‘Guidelines for Intermediaries” on the basis of which it claims Safe Harbor protection from any criminal liability in India.”
