Justice Shinde withdraws comments praising late Stan Swamy after NIA raises objection


A departmental bank of the Bombay High Court, headed by Judge SS Shinde, has withdrawn the oral statements made in praise of the Defendant Elgar Parishad, the late Father Stan Swamy, who recently died of a serious illness.

That came after Additional Attorney General (ASG) Anil Singh, who represented the National Investigation Agency (NIA), objected during a hearing on Friday.

The Bombay High Court on Monday remembered the late Jesuit priest Stan Swamy and said, regardless of the case, they admired his work for society and did not expect his death.

Singh said that a negative perception was created against the NIA and that this undermined the morale of the investigators. The ASG alleged that following Judge Shinde’s statement in a public hearing, it was widely reported in the media.

However, Judge SS Shinde said that even judges are human and the news of Father Stan Swamy’s death on July 5th came suddenly.

Judge Shinde said, “I said, when it comes to legal issues, it’s different. Assuming you’re hurt that I said something personally, I take those words back. We always strive to be balanced. We never made any comments. “… But you see, Mr. Singh, we are human too and suddenly something like this happens.”

Judge Shinde said he will withdraw his comment if it hurts anyone. Judge Shinde also made it clear at the outset that no personal remarks were made against a lawyer or agency in the case.

Judge Shinde further emphasized that he appreciated the conduct of ASG in court and “admired that he was never bound by a case”. The Justice SS Shinde had spoken last week about appreciating Stan Swamy’s work as a tribal leader.

During the hearing, Senior Advocate Mihir Desai, appearing on behalf of Stan Swamy, requested certain instructions from the court in connection with the magistrate’s investigation into the death of Stan Swamy in prison.

He moved the report to the High Court, which the NIA vehemently denied.
