Twitter has failed to comply with law of land, Centre tells Delhi High Court


The center has informed the Delhi High Court that Twitter has failed to comply with the new IT rules. This happens a few days after an affidavit is filed claiming a complaints officer will be appointed and IT rules have been followed.

The center told the Delhi Supreme Court on Monday that Twitter has failed to comply with the new information technology rules, which are the law of the country. The center said Twitter is a “major social media broker” committed to complying with IT rules in 2021.

In its affidavit, the center said: “Twitter Inc. has not complied with the new IT rules, which are constitutional and must be adhered to.”

“Twitter is an important social media intermediary and is obliged to adhere to the provisions of the IT rules 2021 and the compliance rules defined therein.”

“Any non-compliance constitutes a violation of the provisions of the IT rules, which means that Twitter loses the immunity conferred by IT law.”

“Twitter did not appoint the Chief Compliance Officer. The position of resident complainant is also vacant. “

This comes days after Twitter filed an affidavit claiming it was about to appoint a complainant and Compliance with IT rules.

Meanwhile, complaints from India are being handled by staff in the United States, which amounts to a failure to comply with IT rules 2021.

The new rules announced in May of this year oblige social media companies to adhere to the IT rules. Any non-compliance constitutes a violation of the provisions of the IT rules, which can lead to Twitter losing its immunity otherwise available under Section 79 (1) of the IT Act 2000.

At an earlier hearing on May 31, the Delhi Supreme Court asked both Twitter and the Center to submit their responses while claiming that the microblogging site must comply with the new IT rules.
