Twitter India MD Manish Maheshwari playing hide-and-seek, should appear before us: UP Police to Karnataka HC


Uttar Pradesh police on Friday accused Twitter of India’s managing director Manish Maheshwari of playing hide-and-seek and said he should appear before police to answer questions.

Arguing in the Karnataka High Court, that was a hearing Manish Maheshwari’s plea against the police subpoenaThe UP police attorney said, “Manish Maheshwari is the head of the Indian Twitter office and should appear before us.”

Maheshwari’s lawyer told the court that he had been “only a Twitter employee” since June 18. “I’m not the MD.”

In response, UP police said that Manish Maheshwari should then appear in front of them and state that he is not the MD of Twitter India.

After hearing the two sides, the Supreme Court adjourned the matter until July 13, when it will issue its decision.

Earlier this week Manish Maheshwari requested that a notice issued to him by UP police be reversed to request his physical presence in connection with a case registered for the upload and distribution of a “community sensitive” video on the platform.

His attorney argued that the CrPC Section 41-A Notice was “without jurisdiction, without legal sanction”. He claimed that the first notification was made on June 17th under Section 160 of the CrPC. The lawyer argued that the legal obligation under Section 160 of the Criminal Code is based on a person who lives in a place that is within the territorial jurisdiction of the police station where the crime is registered.

Maheshwari had previously signaled that he was ready to participate in the investigation via video conference.

The UP Police issued the Section 41-A notice of the CrPC on June 21, asking him to report to the Loni Border Police Station at 10:30 am on June 24. Maheshwari then appealed to the Karnataka High Court as he lives in Bengaluru, Karnataka.

On June 24, the Supreme Court issued an interim order preventing Ghaziabad police from taking any coercive action against him.

The court claimed that the police could examine him in virtual mode if they wanted to investigate him.
