‘You chose public life’: Bombay HC tells Shilpa Shetty on her plea against media reports


The Bombay Supreme Court on Friday refused to prevent media organizations and social media platforms from disclosing information about actress Shilpa Shetty and her husband Raj Kundra, who were arrested for charges allegedly produce and distribute pornographic films.

Shilpa Shetty had moved the Supreme Court on Thursday accused the media and social media platforms such as Twitter, Facebook, Instagram and YouTube of posting defamatory content about them on their platforms.

When Judge Gautam Patel heard the matter, he said that what Shilpa Shetty is seeking in her plea “will have a deterrent effect on the freedom of the press”. He added, “The coverage of something based on what the police said is not defamatory.”

In her plea, Shilpa Shetty objected to certain media outlets spreading news of her collapse when Mumbai police officers raided Raj Kundra last week into her home for a search.

Attorney Biren Saraf, who appeared for Shilpa Shetty, contradicted such reports, arguing that it was “something that happened between a husband and wife and should not have been reported.”

However, Judge Patel said the crime (Shilpa Shetty collapsed) took place in front of outsiders (police officers) and it was reported from “crime sources”.

The court added that Shilpa Shetty was a public figure and found that such articles were not defamatory.

“You (Shetty) have chosen a public life. Your life is under a microscope. First, Articles that say she cried and argued with her husband when her testimony was recorded is not defamatory. It shows that she is human, “said Judge Gautam Patel.

After hearing the plea, the court stated in its decision: “No part of this order (should) be construed as a gag in the media. I am not issuing an order, but this is not a denial of the interim or injunction. ”Is also sought by Shilpa Shetty.

Judge Patel also made it clear in his order that none of the reports on Shilpa Shetty should relate to the upbringing of her children. “This part is protected by their right to privacy under the broad protections recognized by freedom of the press and balanced with the right to privacy.”

The Supreme Court heard Shilpa Shetty’s petition preventing false, false, malicious and defamatory information against her from being posted on social media and news websites in connection with the arrest of her husband Raj Kundra in connection with the arrest of pornographic films should case.

In the meantime, some respondents took down some videos that Shilpa Shetty had alleged were defamatory in nature. The videos were removed after Shilpa Shetty moved the Bombay High Court.
