Facebook sends notice to Rahul Gandhi over post revealing identity of Delhi minor rape victim’s family

Facebook has asked Congress leader Rahul Gandhi to remove an Instagram post that was the identity of the Delhi Cantt rape victim Family.

On August 1st a Nine year old Dalit girl allegedly raped and murdered and forcibly cremated in southwest Delhi, causing widespread outrage and protest. Rahul Gandhi visited the victim’s family last week and then shared a photo with them on social media. In the caption he wrote that his family was on the path to justice.

NOTICE ON FACEBOOK PROBLEMS, SUBMIT REPORT TO NCPCR

In his letter to Rahul Gandhi, Facebook wrote, “A post you uploaded through your Instagram account is illegal under Section 74 of the Juvenile Justice Act of 2015, Section 23 of the POCSO Act of 2012, and Section 288A of the Indian Criminal Code. In accordance with the notification from the NCPCR, you are requested to remove this post immediately. “

Facebook, which owns Instagram, then submitted an action report to the National Commission for the Protection of Children’s Rights. That NCPCR had previously summoned the social media giant about his non-action on the post. However, following this action, the Commission withdrew its instruction to Facebook to appear before them.

The NCPCR had asked Facebook to take appropriate action against Rahul Gandhi’s Instagram account for violating the provisions of the Juvenile Justice Act 2015, the Child Protection from Sexual Offenses Act (POCSO) 2012 and the Indian Criminal Code.

While Section 74 of the Juvenile Justice Act of 2015 prohibits disclosure of a child’s identity in any form of media, Section 23 of the POCSO Act states that no information or photos that may reveal the child’s identity should be published in any form of form Media.

Earlier, Twitter had blocked Rahul Gandhi’s profile about the same problem.
