The Delhi High Court has allowed a high-level committee to investigate the role of oxygen starvation behind the deaths of Covid-19 patients during the second wave of cases from April to May.
The Supreme Court on Tuesday allowed the body set up by the Delhi government to proceed with its assigned task.
The Delhi Supreme Court passed the order after it was informed that the committee was only a committee of inquiry and that its functioning would not overlap with the mandate of the subgroup established by the Supreme Court’s orders.
Senior attorney Rahul Mehra, who appeared for the Delhi government, told the court that the committee would not hold any liability or pull anyone, including the hospitals, and that the compensation would be paid by the state.
“The criteria for determining the compensation are being examined,” stated judges Vipin Sanghi and Jasmeet Singh.
The decision of the Delhi government to set up the body had previously been suspended by the LG. The LG’s decision had been challenged in the Supreme Court by a woman whose husband allegedly died of Covid-19 in a private hospital due to lack of oxygen.
The plea argued that “there is no reasonable justification for stopping the functioning of the high-level committee, as issues such as health or the granting of voluntary pecuniary benefits or other benefits to the affected sections of society are matters that fall within the exclusive domain” . of the Government of Delhi ”.
The petitioner had further argued that “the non-operationalization of the committee was arbitrary and smells of mala-fide”.
