Delhi HC dismisses CBI plea in INX Media case, allows document inspection by accused


The Delhi Supreme Court rejected a plea by the CBI contesting an order allowing the defendant in the INX Media case to see documents. The case concerns the former Union Minister P. Chidambaram and his son Karti Chidambaram.

The Delhi Supreme Court on Wednesday November 10th dismissed a plea by the Central Bureau of Investigation contesting an order allowing the defendant in the INX Media case to copy / review documents. The case concerns the former Union Minister P. Chidambaram and his son Karti Chidambaram.

In 2017, the CBI had registered an FIR for alleged irregularities in the Foreign Investment Promotion Board (FIPB) approval granted to INX Media Group for receiving foreign funds of Rs 305 billion. P. Chidambaram was then finance minister of the Union in the UPA government.

The CBI had also alleged that INX Media hired a company affiliated with Karti Chidambaram to resolve an issue with the income tax authority and received improper favors in return.

The court heard on Wednesday the CBI’s appeal against a special court order in March that would allow access to the immalkhana“(Room in which case property is kept) by the defendant. The Special Court had stated that, in order to ensure a fair trial, the CBI was required to submit or produce all documents collected during the investigation or statements recorded by it, and that the defendants were also entitled to copies of these documents.

The CBI had challenged the court’s special order that access to documents by the accused could lead to manipulation of evidence.

According to Bar and Bench, one of the reasons the CBI challenged was because the case involved “high levels of corruption” with “wide implications” for society. The Central Authority stated that while the accused had the right to a fair trial, the collective interest of society could not be prejudiced.
